Elder Law

When the overwhelming costs of long term nursing care or a loved one’s incapacity is a concern, Rebecca assists clients in evaluating their assets and creating plans for the management and possible protection of resources, including complex gift and promissory note plans for last minute transfers. Additionally, she provides assistance with the arduous process of preparing Medicaid applications.

Guardianships

When a loved one is unable to provide for his or her personal or financial well-being due to disability or incapacity, Rebecca assists in seeking the court appointment of a guardian for such individuals under Article 81 of the Mental Hygiene Law and Article 17-A of the Surrogate's Court Procedure Act. Additionally, she assists clients with matters that arise after the appointment of a guardian, such as annual accounting questions, seeking modifications of the powers of guardian, the appointment of standby guardians, transfers of guardianship to other states and the termination of guardianships.

Estate Planning

Rebecca assists her clients in understanding their options and provides guidance for an estate plan tailored to their unique needs and wishes. Recommended plans may include Powers of Attorney, Healthcare Proxies and other advance directives, the preparation of estate planning documents, including Wills, Revocable Trusts, Supplemental Needs Trusts, Medicaid Asset Protection Trusts, Life Insurance Trusts and Charitable Trusts, and plans to avoid estate tax.

Trust and Estates Administration

Rebecca helps clients navigate the administration process for Estates and Trusts, including petitions for the probate of Wills or administration of Intestate Estates, marshalling assets and the sale and liquidation thereof, assessing valid liabilities and the ultimate distribution of assets, which includes the preparation and filing of accountings, and the release or discharge of Executors, Administrators and Trustees.
